WONSULTING TERMS & AGREEMENT

Thank you for choosing to hire Wonsulting. We take your commitment to invest in your career advancement seriously. We are excited to help you with the tools and strategies that have helped our clients receive great results. To help us have a great start, here are the terms and conditions to accept with your purchase. 


Wonsulting's clients have an excellent record of landing jobs and advancing their careers. While Wonsulting's clients have achieved notable success in securing employment and progressing in their careers, it's important to understand that Wonsulting does not provide a guarantee of job placement or promotion as an outcome of utilizing our services. The dynamics of the job market lie beyond the control of career services. 


You, the individual whose name is printed below and is referred to herein as (“Client”, “you” or “your”), in exchange for services to be provided by Wonsulting Inc. (“Wonsulting” or “we,” “our,” or “us”) agrees to the following terms and conditions (“Terms”):


These Terms create a binding agreement between you and Wonsulting and govern any and all services provided to you by or through Wonsulting, whether through an electronic platform, by phone or in person (“Services”), subject to your compliance with all the terms, conditions, and notices contained or referenced herein. Please read these Terms carefully before purchasing or receiving any “Service”, “Product” or “Program”. These Terms will govern all Services you receive from us. By electronically signing below, you acknowledge that you have read and understand your duties and responsibilities as outlined in these Terms and you accept and agree to be bound by these Terms. These Terms affect your legal rights and obligations, so if you do not agree to these Terms, do not sign below and do not receive any Services from Wonsulting.


  1. Wonsulting shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from or in connection with the use of our services. This includes, but is not limited to, loss of data, loss of profits, or any other losses resulting from advice, information, or recommendations provided through our services.
  1. You understand and acknowledge that any decisions you make based on our advice or recommendations are at your own risk. We strongly recommend seeking additional professional advice before making significant career-related decisions.
  1. You are solely responsible for the accuracy and completeness of any information you provide to us, including but not limited to your resume, cover letter, and personal background. We do not verify the accuracy of the information provided by clients.
  1. Any reliance on the information, advice, or recommendations provided by Wonsulting is solely at your own discretion.
  1. Wonsulting is committed to maintaining the confidentiality of your personal information and any materials you provide to us. However, we cannot guarantee the security of electronic transmissions and cannot be held responsible for any unauthorized access to or disclosure of your information.
  1. You agree to indemnify, defend, and hold Wonsulting and its officers, employees, and agents harmless from any claims, damages, liabilities, and expenses arising from your use of our services or your violation of these Terms and Conditions.
  1. Wonsulting reserves the right to modify or terminate its services, website, or these Terms and Conditions at any time without prior notice. It is your responsibility to review these terms periodically for any changes.
  1. This Agreement shall be governed by and construed in accordance with the laws of Los Angeles, without regard to its conflict of laws principles.

Wonsulting Services

The services provided by Wonsulting covered under this section of the agreement encompass Career Consulting, Resume Revision, LinkedIn Revision, Cover Letter Revision, AutoApply, Job Search Strategy, and Interview Preparation Services. This also includes our service bundle offerings, namely the Starter package, the Land The Job package, and the Ultimate package.


In respect to all services acquired, it's essential to recognize that these engagements entail a collaborative effort between us. By the same token, you commit to actively participating in the recommended activities to yield optimal job search outcomes. It's important to note that without your active involvement, the outcomes may not align with your expectations, and the assured quality of services cannot be ensured. In such instances, Wonsulting holds no responsibility for any outcomes resulting from your limited engagement.


Should you choose to acquire our service via a one-time payment, it's imperative to acknowledge that the entire fees are gathered in their entirety prior to the commencement of any service provision.

If you opt to procure our service through a payment plan, it is important to recognize that the recurring payments associated with this arrangement do not constitute a subscription fee. Instead, they represent scheduled installment payments that collectively cover the total cost of the services you have selected. It's worth noting that once you commit to a payment plan, you are unable to terminate or cancel the plan prematurely.‍ For more information on how payment plans work, see Shoppay and Paypal.


You understand and consent that your service consultations will be recorded for internal purposes such as quality monitoring, service provider training purposes and for proof of service completion. The recordings of the sessions will be sent to you after your consultations upon request.  


Wonsulting retains the authority to retain your service documents for a duration of up to 6 months subsequent to the delivery of your services. It is your responsibility to ensure the download of any essential materials for your future reference. Please acknowledge that Wonsulting cannot be held responsible for any loss of documents occurring after the completion of the services.

 

CLIENT’S RESPONSIBILITY ON SERVICES RENDERED: 

As a client, you acknowledge and agree that while Wonsulting provides the best available tools, ideas, advice, and commercially available data, we cannot be responsible for the changing market conditions, job posting changes, or a client’s persistence, attitude, and willingness to implement their action plan. NO VERBAL OR WRITTEN PROMISE OR GUARANTEE OF ANY JOB OR EMPLOYMENT IS MADE OR IMPLIED UNDER THE TERMS OF THE CONTRACT. Ultimately, your success in the job market is solely your responsibility. 

Your service includes professionally written documents also known as marketing and branding documents and/or career development sessions. As the client, you are responsible for reviewing your completed documents from our service providers for completeness and accuracy. Wonsulting is not liable for any damage caused by omissions, false statements, or inaccuracies. We work with you through the document edit phase. As the client, it is your responsibility to review and finalize your documents before using them. If you find it necessary to make modifications to your personalized written document prepared by Wonsulting, we kindly ask that you submit a written request prior to the conclusion of your service. It's important to be aware that any requests made subsequent to this point will regrettably not be accommodated.

GENERAL REVISION POLICY: 

NOTE: Resume Review, Linkedin Review and Cover Letter services include 1 round of complimentary edits which must be conducted before services are considered complete. A revision is defined as minor when changes to the text or shifts in the content are slight and/or still directed towards the same job roles/industry/etc. Substantial changes, for example, a change of job focus, strategy, target audience, or anything that requires completely rethinking or re-strategizing are considered a rewrite and will incur extra charges and a revised project due date. 

Rough drafts of the documents will focus on the information presented by you, the client. This can be the form of supporting documents, discovery calls, and/or the initial consultation. It is our policy that all revisions must be submitted in writing within 3 calendar days of receiving your draft(s). If contact is not made within 3 calendar days, an order automatically becomes finalized on the 3rd calendar day. Any edits requested on or after the final version is delivered will be charged a revision fee, so it’s imperative to voice any feedback beforehand The fee will be determined based on the details of the request. Kindly be aware that your service is deemed as concluded after a period of 3 calendar days from the date you receive your finalized professionally written document and/or participate in your final career development session.

GENERAL REFUND POLICY: 

At Wonsulting, our commitment is to deliver tailored services to each individual client, focusing on offering top-quality assistance, consultations, information gathering, and the creation of career-related documents. It's important to acknowledge that refunds for Wonsulting services are not provided, as all transactions are considered final.

While purchased services are non-refundable, you have the option to gift any unused services to a nominee of your choice. To initiate this process, kindly email happy@wonsulting.com indicating your intention to gift the service within 3 months from the date of purchase, as long as no progress has been made on the service(s) in question.

Alternatively, you have the opportunity to temporarily pause services that are yet to be initiated, with a grace period of up to 3 months from the date of purchase.For services that have been initiated, you have the opportunity to temporarily pause your remaining services for up to 1 month from the date of purchase. In both cases, should either of these periods expire, the service(s) will be considered completed and no longer usable.

It's worth noting that our fees contribute to the development of personalized questionnaires, interview inquiries, client consultations or coaching, writing, editorial work, design, layout, editing, proofreading, and finalization of documents. These elements involve substantial time and intellectual property investment, which cannot be recovered. Requests for refunds concerning services will not be accommodated. However, if you require assistance prior to the completion of your services, you can request a revision, adhering to the guidelines outlined in our general revision policy.

The initiation of Wonsulting services may require up to 10 business days, and it's important to note that we do not presently offer expedited service options. This decision is rooted in our commitment to maintaining the quality of our services at a high standard. Delays attributable to circumstances on your part, such as providing an incorrect email address in the form, scheduling appointments for later dates, failing to attend consultations, or responding to your career consultant belatedly, will not qualify for refunds.

You understand and consent that your services are valid for up to 3 months from date of purchase.

AUTOAPPLY SERVICE REFUND POLICY: 

Our primary aim is to remain adaptable in our efforts to guide you toward achieving your desired career objectives. In instances where we are unable to fulfill the designated count of job applications (as specified in the service form you complete) during the initial job search phase:

We will kindly request supplemental information, which entails providing 5 alternative job titles and 5 alternative locations. This step is taken to optimize our endeavors in aligning you with the intended volume of job applications.

Should our additional job searches not yield the desired outcome of matching you with a satisfactory number of suitable positions, you possess the option to request a refund of up to 5%, exclusively for the AutoApply service (excluding the Bundle Price). By acknowledging this, you also concur that if there is a scarcity of opportunities within your preferred role(s), you agree to a refund limited to a maximum of 5%. These fees encompass the time invested in scouring job opportunities that correspond to your years of experience, preferred job titles, and chosen locations.

Furthermore, you acknowledge that Wonsulting's AutoApply service is not designed as a referral service. Its function is solely to facilitate job applications as it is a one-off application service (non-continuous), and we do not provide assurances regarding the outcomes of these applications. It's important to comprehend and agree that Wonsulting does not guarantee the attainment of job interviews through the utilization of this service. This service also does not include any consultation calls. Moreover, you recognize the necessity of confirming your approval for the jobs you authorize Wonsulting to apply for within a span of 2 business days after receiving the job list from our team. Failure to respond to Wonsulting team during this timeframe is taken as automatic consent to apply to the job lists.

You are welcome to communicate your desired salary and visa status, but Wonsulting does not guarantee alignment between the jobs we apply for on your behalf and any additional requirements outside of our expertise. This is subject to several variables including economic conditions, your professional background, the role, industry, and geographical considerations, among others. Wonsulting cannot provide a guarantee for obtaining a work visa, and will only search for jobs in locations where you possess a legal authorization to work without necessitating a work permit. 

Presently, Wonsulting exclusively offers job searches with an H1B visa filter, which involves identifying job opportunities within companies that have previously offered H1B visas (for the USA) based on historical data from the H1B database. However, it's important to note that this does not ensure that the listed companies currently offer H1B visas. If you choose the H1B visa option, the job listings will include roles from companies that have previously extended H1B visas.

By enrolling in the AutoApply service, you acknowledge that Wonsulting lacks control over the H1B application process. Consequently, we cannot be held accountable in cases where a company no longer provides H1B visas for a particular job listing. For work visas in other countries, Wonsulting does not currently offer job listing searches or filtering options. Again, we will only search for jobs in locations where you possess the legal authorization to work.

Wonsulting also offers job searches with an industry filter, which involves identifying job opportunities with companies within a specific industry of your choice.  Please note that should you choose to move forward with a searches that have the H1B filter and/or industry filter added, you will receive a list of 25 jobs.  Clients who move forward with searches that do not have these filters added will receive a list of 50 jobs.

Prior to starting your AutoApply service, you will need to disclose job applications you’ve made prior to avoid multiple applications sent on your behalf. In addition, you will need to clarify skills you do not have as our team will use this information as consideration in completing your job list. You must notify those skills to your service provider prior to AutoApply service initiation as no changes will be made post-job list compilation if the job postings require prerequisite skills you do not have which were not previously disclosed.

To reiterate, the filter criterias of our job search for the AutoApply service is limited only to job title, years of experience, location, H1B visa requirements, and industry. It's important to recognize that no refunds will be issued in cases where securing an interview through our AutoApply service does not occur or if the recommended job applications made on your behalf do not meet your salary expectations.

PAUSING OF SERVICES OR CLIENT UNRESPONSIVENESS

Wonsulting has established protocols to handle scenarios wherein clients are unresponsive to email communications and for scenarios wherein clients schedule appointments but fail to attend meetings with their designated service providers. Please note that Wonsulting is not liable for any delays caused in the event that your services are paused.


For individual services:

Should you fail to complete your services form within 2 weeks from the date of purchase, your services will be temporarily paused as we require your information to start your services. To reactivate your services and prevent them from expiring, kindly contact happy@wonsulting.com within a period of 3 months.

In cases where you have already submitted the form but exhibit unresponsiveness to emails for more than 3 days or miss / reschedule more than 2 scheduled consultations, a video recording will be provided to you, encompassing a review of your materials. However, it's important to note that while these materials may be tailored, we cannot guarantee that they will encompass your experience or background as comprehensively as when our service providers are able to gather necessary information from you. Please refer to our FAQ for comprehensive details on the processes involved in each of our services.

Kindly take note that upon unpausing your services, it is essential to schedule your remaining consultations with your service provider within 3 business days. Failure to schedule these consultations within this timeframe will result in a recording being sent to you, and your service will be considered complete.


For bundle services:

Should you fail to schedule your onboarding call within 2 weeks from the date of purchase, your services will be temporarily paused as our service provider will need to walk you through the bundle services process. You will also only be asked to fill the form during the onboarding call so that your service provider can go through your information as you fill the form. Since this is the case, if an onboarding call is not scheduled, Wonsulting will be unable to start your services. To reactivate your services and prevent them from expiring, kindly contact happy@wonsulting.com within a period of 3 months from the purchase date.

In cases where you have already attended an onboarding call but exhibit unresponsiveness to emails or miss / reschedule up to 2 scheduled consultations, our service providers will do their best to complete the services with the information that they do have. As the latter services in a bundle may rely on previous sessions for more information (ie. Interview Prep), our service providers may not be able to proceed with their consulting if clients are unresponsive. As a result, in these situations, you will be sent recording videos and deliverables based on the information you submitted to us and your services will be marked as complete. 

If you have already completed your onboarding call but decide that you wish to pause any of your remaining services, you will have 1 month to reactivate your services. Additionally, if you are in the middle of a service (e.g you have received your initial resume draft), you cannot pause that particular service until that service has concluded in its entirety (e.g. you continue working with your service provider to receive a finalized resume). If you have completed your most recent service (e.g. your resume service), you may pause the remainder of your service package for up to 1 month if needed.

Kindly take note that upon unpausing your services, it is essential to schedule your remaining consultations with your service provider within 3 business days. Failure to schedule these consultations within this timeframe will result in a recording being sent to you, and your service will be considered complete.


AGREEMENT TO SERVICES AS LAID OUT ON OUR WEBSITE AND FAQ

By acknowledging these terms, you agree to undergo our service processes as they are listed on our website/in our FAQ.  If you need clarification on what each of these services look like before purchasing, you can reach out to our team at hello@wonsulting.com.

NO-SHOW AND RESCHEDULING POLICY

At Wonsulting, we understand the value of punctuality and prioritize providing the best customer service to our clients. To ensure that all appointments run smoothly and efficiently, we have established the following policy regarding no-shows and reschedules.

Definition:

A no-show is a client who either fails to attend a scheduled appointment or cancels an appointment with less than 24 hours notice. 

A reschedule is defined as a client who requests to change the date and time of a scheduled meeting with at least 24 hours notice.

Maximum Allowable No-Shows and Reschedules for Bundle Services:

For bundle services, clients have a maximum allowance of two (2) reschedules per bundle. It's important to note that a “no show” will reduce the remaining reschedules to one (1) for the remainder of the bundle. Any additional reschedules beyond the permitted limit will not be accommodated.

If you exceed the limit of 2 reschedules or have 1 no-show instances, the service will be considered complete. At that point, the resources related to your services will be automatically sent to you via email.

Maximum Allowable No-Shows and Reschedules for Individual Services:

For individual services, clients have a maximum allowance of two (2) reschedules per service. It's important to note that a “no show” will reduce the remaining reschedules to one (1) for the remainder of the client’s service. Any additional reschedules beyond the permitted limit will not be accommodated.

If you exceed the limit of 2 reschedules or have 1 no-show instances, the service will be considered complete. At that point, the resources related to your services will be automatically sent to you via email.

Notice for Rescheduling:

Clients are encouraged to provide at least 24 hours' notice for rescheduling appointments to ensure efficient scheduling for all clients and their respective service providers. This policy is in place to ensure the best possible customer service and prompt scheduling for all clients and their respective service providers. Thank you for your cooperation and understanding.

As a result of any no-shows or rescheduling, you understand and consent that your services will be delayed.


REACTIVATING PAUSED SERVICES: 

To reactivate any paused service, kindly get in touch with us at happy@wonsulting.com. In cases where your service has lapsed – indicating that you have contacted Wonsulting three months after the initial purchase and wish to reinstate the service – a reactivation fee of 20% will be applicable.

Kindly take note that upon unpausing your services, it is essential to schedule your remaining consultations with your service provider within 3 business days. Failure to schedule these consultations within this timeframe will result in a recording being sent to you, and your service will be considered complete.

OTHER TERMS AND CONDITIONS: 

Survival of Provisions. The provisions of Sections (Terms and Fees) hereof shall survive termination of this Agreement for whatever cause, including, but not limited to the mutual agreement to terminate this Agreement by both parties hereto.

Passwords. All access codes and passwords that are personal to the individual will be provided to Wonsulting. Company Personnel are responsible for maintaining the confidentiality and security of all access code and passwords provided and ensuring that each access code and password is only used by the individual authorized. 

‍

Wonsulting reserves the right to refuse service, terminate a client relationship, or otherwise cancel orders at their sole discretion. Wonsulting is under no legal obligation to refund the purchase price of any service under any circumstance. However, we will seek to satisfy every client within reasonable accommodation.

Wonsulting Course

 This section of the agreement encompasses the Wonsulting Career Course, an online course provided by Wonsulting covering the Basic, Premium and Elite options.

1. Upon your payment of the price listed on this website for the Wonsulting “Program” you have selected (the “Payment”), Wonsulting shall provide access to the Wonsulting Online Course: The Entire Recruiting Cycle Landing the Offer (the “Program”) to you at the level selected online, subject to your compliance with all the terms, conditions, and notices contained or referenced herein. The Program includes access to career coaching content, including videos, resources, and templates. Additional resources and services are dependent upon which level you chose to purchase (i.e., Basic, Standard or Pro). Certain services may be available on a limited basis, including but not limited to one-on-one counseling sessions and may be subject to additional terms and conditions. You certify that you are eighteen (18) years of age or older and, if you are not an adult in the jurisdiction in which you reside (typically eighteen (18) years of age in United States), you have the consent and approval of your parent or legal guardian to receive the Services. In addition, you represent and warrant that you have the right, authority and capacity to enter into and abide by these Terms.

2. In consideration of the opportunity to access the Program, you agree to pay Wonsulting the Payment. You agree to make all payments to “Wonsulting” through electronic payment through a site designated by Wonsulting. All payments to Wonsulting are handled through a third-party website that is not operated or controlled by Wonsulting. Please read the terms and conditions of and payment options provided by, any such website carefully. Once you have been granted access to the Program materials, there are no returns or refunds. Notwithstanding this limitation, Wonsulting does offer a 30-Day Money-Back Guarantee for those whose thorough participation in the Program did not yield any “results” (as defined below) and who have completed each of the stets (a-d) set forth below. For the purposes of this Money-Back Guarantee, the Program has yielded “results” if any individual or entity that you contact as a part of your participation in the Program responds to you and/or sends you a Linkedin connection request. If you complete all steps as outlined in a-d below AND have not received any response or any connection requests from any such individuals or entities, you are eligible for a refund under this guarantee. In order to qualify for the Money-Back Guarantee, you must submit a request for a refund to hello@wonsulting.com within 30 days of your purchase of the Program with proof that you have completed each of the following steps:

a. You have watched every video included in the Program to 100% completion.

b. You have completed every quiz at the end of each of the 6 sections of the Program with a 100% score.

c. You have completed each “Action Item” at the end of each of the 6 sections of the Program.

d. You have emailed hello@wonsulting.com with a question about your situation that’s preventing you from receiving results.

3. These Terms shall apply to any and all Services you receive from Wonsulting, including but not limited participation in the Program. Wonsulting may terminate our obligation to provide Services to you, and limit, suspend, or terminate Client’s participation in the Program without refund or forgiveness of monthly payments at any time, if we determine that such termination is in the best interest of Wonsulting, if Client becomes disruptive to Wonsulting or participants, Client fails to follow the Program guidelines, is difficult to work with, or impairs the participation of the other participants in the Program. In addition, and notwithstanding the foregoing provision, our obligation to perform the Services will terminate automatically, and no refund will be provided, if you fail to comply with any provision of these Terms or fail to adhere to our policies.

4. While career coaching involves helping you identify and achieve your personal career goals, you understand and acknowledge that no result whatsoever is guaranteed by Wonsulting, including, but not limited to job offers, reached career goals, increased earnings, or any life change or improvement. You accept and agree that you are completely responsible for your progress and results from the Program. Company makes no representations, warranties or guarantees verbally or in writing. You understand that the statements “land your dream job” and “landing the offer” are marketing slogans and refer to the aspirations of our clients. It is in no way a promise, guarantee or representation about the results of our Services or any Program. You understand that because of the nature of the program and extent, the results experienced by each client may significantly vary. You further understand that there may be inherent risks associated with the advice and coaching given to you, and you voluntarily assume these risks and accept full responsibility for the outcomes and consequences of your own actions and choices that may arise out of the Services. Program education and information is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual.

5. All of the materials provided by Wonsulting are protected from copying under U.S. and international copyright laws and treatises. Any unauthorized copying, alteration, distribution, transmission, performance, display or other use of this material is prohibited.

6. Wonsulting shall treat all discussions as confidential, and, unless required to do so by law or because of circumstances that Wonsulting determines, in its sole and absolute discretion, is for the health, safety or welfare of you or another individual, Wonsulting shall not disclose any confidential information belonging to you, other than disclosures which might be made in the process of rendering the Services. You agree to treat any information shared by other Program participants as confidential. In addition, all information provided to you through the Program or through any other Services (“Proprietary Information”) is confidential, proprietary, and belongs solely and exclusively to Wonsulting. You understand and agree not to use or disclose such Proprietary Information in any manner other than for your personal use as contemplated by the Program. Proprietary Information shall not include information rightfully obtained from a third party. Further, by purchasing access to the Program, you agree that if you violate or display any likelihood of violating this section the Company will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

7. We are responsible only for performing the Services expressly provided for in these Terms. You agree to waive and release any and all present and future claims against us for negligence, loss, costs, or other damages to you as a result of the Services you receive, and we shall only be liable for gross negligence and intentional misconduct. We assume no responsibility for errors or omissions that may appear in any of the Program materials.

8. In addition, and separate from the protections provided elsewhere in these Terms, to the extent that you have any valid claim or action against Wonsulting, you agree that our maximum aggregate liability to you shall not exceed the total amount you have paid to us for the Services. Further, if all or any part of these Terms shall be held invalid or unenforceable, it shall be enforced to the maximum extent permitted by law, and any portion that is not invalid or unenforceable shall, notwithstanding, continue in full legal force and effect. If we bring suit or use an attorney to collect, or enforce the payment of any Package Payments or other fees due under these Terms, then you shall pay us all costs of collection and enforcement, including reasonable attorney’s fees and court costs in addition to any and all other amounts due.

9. The foregoing provisions of Paragraphs 8 and 9 are for the benefit of Wonsulting, and these provisions shall constitute our entire liability and your sole and exclusive remedy, and shall survive any termination of these Terms.

10. You agree to indemnify Wonsulting from and against any loss or damage, including reasonable attorney fees and disbursements, caused by or arising out of any breach or alleged breach of any representation made by you herein.

11. You represent and warrant that you have the power and the legal authority to accept and agree to these Terms on behalf of yourself.

12. These Terms and your and our obligations hereunder shall be governed, construed and interpreted by, through and under the Laws of the State of California, without regard for conflict of laws. Any controversy or claim relating to these Terms and/or the Services shall be settled by binding arbitration. Any arbitration arising out of these Terms or the Services shall be submitted the American Arbitration Association pursuant to American Arbitration Rules and Procedures and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. For all matters arising out of or relating to these Terms or out of the Services, you agree to submit to the jurisdiction of the State of California. Any arbitration proceeding shall take place and the arbitration award given in writing in Los Angeles County, California.

13. Other than as specifically provided in these Terms, these Terms may only be amended, waived, or modified by a writing referencing these Terms and signed by Wonsulting and accepted by you. No waiver of any of the provisions in these Terms shall be deemed, or shall constitute, a waiver of any other provision of these Terms (whether or not similar), nor shall any such waiver constitute a continuing waiver unless otherwise expressly provided. These Terms constitute the entire agreement between us and you, and there are no other prior or contemporaneous written or oral agreements, understandings, promises, discussions, warranties or covenants not specifically referred to or contained in these Terms. Any rights you have to the Services and to any sessions are not assignable or transferable by you. You may not provide anyone else with access to the Program or to any of the Services. Wonsulting has the right to freely assign its rights and obligations under these Terms.

14. Any notice to you given in relation or pursuant to these Terms shall be in writing and shall be delivered personally, by electronic mail, addressed using the information you have provided to us when you register for Services. Service of any such communication shall be deemed made on the date of actual receipt at such address. You or we may, from time to time, by notice in writing served upon the other party as aforesaid, designate a different electronic mail address, different person, or reasonable additional persons to whom all communications are thereafter to be made.

15. Your agreement to and acceptance of these Terms may be executed by providing an electronic signature under the terms of the Electronic Signatures Act, 15 U.S.C. SS 7001 et. seq. and/or the Uniform Electronic Transactions Act, California Civil Code §§1633.1 et. seq., and may not be denied legal effect solely because it is in electronic form or permits the completion of the business transaction referenced herein electronically instead of in person. You agree that any electronic signature you provide shall be as valid as an original signature shall be effective to bind you to these Terms. Wonsulting shall be entitled to rely on your electronic signature to authenticate this writing and to have the same force and effect as a manual signature.

16. You understand and agree that this document is a legal and binding agreement on you and your family, spouse, and heirs, enforceable in accordance with its terms, and if you have any questions about any part of these Terms, you will have it reviewed by an attorney before you sign it.

By accepting these Terms you agree to be bound to all of the provisions contained in these Terms.  

CONCLUSION

These Terms and Conditions constitute the entire agreement between you and Wonsulting regarding the subject matter hereof and supersede any prior agreements or understandings, whether written or oral.
